Website terms of use

The rules for using this website, its free tools and its forms. They are short on purpose. Work we do for clients is covered by a separate written agreement, not by this page.

1. Who we are and what these terms cover

This website, blackmountaintech.co.uk, is operated by Black Mountain Technology Group Ltd (company number 16800922), trading as Black Mountain Tech, of 4th Floor, 14 Museum Place, Cardiff CF10 3BH. You can contact us at contact@blackmountaintech.co.uk.

These terms apply to anyone who uses the site, including the free website audit, the speed check, the blog, and the booking and contact forms. By using the site you agree to them. If you do not agree, please do not use the site. Our privacy policy explains how we handle personal data and cookies and forms part of these terms.

2. Access to the site

The site is provided free of charge and on an “as is” and “as available” basis. We may change, suspend or withdraw any part of it at any time, for example to add or remove features, fix problems, or for security or legal reasons. We do not promise the site will always be available or free of interruptions, and we are not liable if it is unavailable for any period.

3. Free tools, audits and calculators

The website audit, speed check and any calculators on this site are automated and free. Their results are generated by software from publicly available data (including Google's PageSpeed Insights service) and from the figures you enter, such as visitor numbers or average order value.

  • Results are indicative estimates intended to start a conversation. They are not a professional audit, a guarantee of performance, or a prediction of revenue, rankings or sales.
  • They depend on the accuracy of what you enter and on third-party data we do not control. Scores and figures can vary between runs.
  • You should not make business, financial or technical decisions on the basis of these results alone. Speak to us, or another professional, before acting on them.
  • You may only run the tools against websites you own or are authorised to test.

4. Enquiries, booking requests and prices

Submitting the contact form, requesting a call, or asking for a quote does not create a contract between us, and places no obligation on either side. A booking request is a request for a time, not a confirmed appointment, until we confirm it.

Prices shown on this site, including “from” prices and fixed-price products, are indicative and exclude VAT unless stated otherwise. They apply to the scope described and may change. A price becomes binding only when it is set out in a written scope, proposal or invoice that you have accepted.

Any work we carry out for you is governed by a separate written agreement (our terms of business, a proposal or a statement of work). If that agreement conflicts with these terms, that agreement takes priority for the work it covers.

5. Our content and intellectual property

Everything on the site, including text, design, code, images, logos, case studies and tools, is owned by us or our licensors and protected by copyright, trade mark and other laws. Client logos and names appear with permission and remain the property of those clients.

You may view the site and print or download extracts for your own use, or to evaluate our services for your business. You may not copy, reproduce, republish, sell or commercially exploit any part of the site, remove copyright notices, or use our name or logos without our written permission.

6. Acceptable use

You must use the site lawfully and must not:

  • attempt to gain unauthorised access to the site, its servers or any connected system;
  • introduce viruses, malware or other harmful code, or attack the site (for example by denial of service);
  • use automated tools to scrape, harvest or extract data from the site, or submit forms in bulk;
  • submit false, misleading or abusive information through our forms, or impersonate anyone;
  • use the free tools against websites you are not authorised to test, or in a way that places unreasonable load on them.

Doing any of these is a breach of these terms and may be a criminal offence under the Computer Misuse Act 1990. We may report it to the authorities and will stop you using the site.

7. Information, not advice

Blog posts, guides, case studies and other content on the site are general information. They are not professional advice and may not apply to your circumstances. We try to keep content accurate and current but make no promise that it is complete, correct or up to date, and we are under no obligation to update it. Results described in case studies are specific to those clients and are not a guarantee of similar results for you.

The site links to third-party websites and services. These are provided for your convenience. We have no control over them, do not endorse them, and are not responsible for their content, accuracy or availability.

You may link to our homepage in a fair and lawful way that does not suggest any association, approval or endorsement by us where none exists. You may not frame the site or link in a way that damages our reputation. We may withdraw linking permission at any time.

9. Viruses and security

We take reasonable steps to keep the site secure, but we do not guarantee it is free of viruses or other harmful material. You are responsible for your own device, software and virus protection when you use the site or download anything from it.

10. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of England and Wales. Each paragraph in this section is separate and applies even if another is found to be unenforceable.

If you use the site for business purposes:

  • we exclude all implied conditions, warranties and other terms that may apply to the site or its content;
  • we are not liable for any loss of profit, revenue, business, contracts, data, goodwill or anticipated savings, or for any indirect or consequential loss, arising from your use of the site, its tools or its content, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable;
  • we are not liable for any loss arising from reliance on the results of the free tools, or on information on the site, where that reliance is not confirmed in a written agreement with us.

If you use the site as a consumer:

  • the site is provided for private, non-commercial use. We are not liable for any loss of profit, loss of business or business interruption;
  • we are liable for foreseeable loss or damage caused by our breach of these terms or our negligence, but not for loss that was not foreseeable when you started using the site;
  • nothing in these terms affects your statutory rights.

11. Changes to these terms

We may update these terms to reflect changes to the site, our services, the law or best practice. The current version is always at this address, with the date at the top. Changes apply from the date they are published and do not apply retrospectively. If you use the site after a change you accept the updated terms.

12. General

  • If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
  • If we do not enforce a right under these terms straight away, we can still enforce it later.
  • These terms are between you and us. No one else has any right to enforce them.
  • We may transfer our rights under these terms to another organisation; your rights will not be affected.

13. Governing law and where disputes are dealt with

These terms are governed by the law of England and Wales. If you are a business, the courts of England and Wales have exclusive jurisdiction over any dispute. If you are a consumer, you may bring a claim in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation.

14. Contact

Questions about these terms: contact@blackmountaintech.co.uk, or write to Black Mountain Technology Group Ltd, 4th Floor, 14 Museum Place, Cardiff CF10 3BH.
